These terms govern your use of the amagrow.co.za website and, together with any written proposal or order, the services we provide. By using this site or our services, you agree to these terms.

AmaGrow provides digital marketing and AI automation services for businesses, including websites, social media management, advertising management, AI assistants, and subscription software products such as our AI lead-finding tools. The exact scope, deliverables and pricing for your service are set out on this website, in our product pages, or in a written proposal or invoice.

3. Subscriptions and billing

• Subscription products are billed monthly in advance in South African Rand, plus any once-off setup fee shown at signup.
• Subscriptions are month to month unless a minimum term is stated for a specific product on this page. Where no minimum term applies, there is no notice period and you can cancel at any time.
• Card payments are processed securely by Paystack. We do not store your card details.
• Full billing, cancellation and refund detail is in our Billing & Refunds policy, which forms part of these terms.

Site-as-a-Service and Shop-as-a-Service run on a 12-month minimum term, billed monthly. After month 12 the website and all its content become the client's property at no extra cost, and the client can keep the monthly plan going for hosting and care or move the site to their own hosting.

4. Fair use

Plans described as "unlimited" carry a reasonable daily fair-use limit so that the service stays fast and reliable for everyone. Genuine business use will not hit these limits. We may adjust fair-use thresholds with notice.

5. Acceptable use

• You may not use our services to break any law, including POPIA and consumer protection law.
• Lead data supplied by our tools consists of publicly listed business information intended for business-to-business contact. You are responsible for using it lawfully, including honouring opt-outs and direct-marketing rules.
• You may not attempt to breach, probe or overload our systems, scrape our platforms, or resell access without our written agreement.

6. Your data and ownership

Data generated inside your subscription, such as leads, notes and pipeline records, belongs to you. You can export it at any time. After cancellation we keep it for 30 days in case you return, then delete it permanently. Our software, designs, characters and systems remain the property of Amagrow (Pty) Ltd.

7. Service availability

We work to keep our services available and reliable, but no online service can guarantee uninterrupted availability. Where we or our infrastructure providers need to perform maintenance, we aim to minimise disruption.

8. Limitation of liability

To the extent permitted by law, AmaGrow's total liability for any claim relating to a service is limited to the amount you paid us for that service in the three months before the claim arose. Nothing in these terms limits liability that cannot lawfully be limited, and nothing removes your rights under the Consumer Protection Act where it applies.

10. Changes and law

We may update these terms from time to time; the latest version lives on this page. These terms are governed by South African law.
